Daughter sues doctor, hospital, alleging malpractice in mother's cancer death

A Cook County woman is suing a doctor and hospital, alleging wrongful death in a case involving her mother.

Abigail Fernandez, special administrator of the estate of Teresa Monrroy, filed a lawsuit Sept. 17 in Cook County Circuit Court against Dr. Giovani Giannotti, Boffa Surgical Group, and Presence St. Mary and Elizabeth Medical Center.

According to the lawsuit, after Monrroy had a biopsy that detected breast cancer in September 2011, Dr. Giannotti performed a lumpectomy Oct. 14, 2011. However, the suit says Monrroy’s cancer had spread to her liver and spine, causing her death Jan. 26, 2012.

Under the Illinois Wrongful Death Act, the lawsuit alleges the defendants were at fault for failing to remove the cancer completely and prevent it from spreading.

Fernandez seeks a jury trial and damages of more than $50,000, plus legal costs. She is represented by attorneys Stephan D. Blandin and Michael E. Holden of Romanucci & Blandin in Chicago.
