Daughter accuses St. Mary of Nazareth Hospital of malpractice in mother’s death

A Cook County woman is suing her mother’s health care providers, alleging wrongful death and malpractice.

Ada Aviles, special administrator of the estate of Iraida Aviles, filed a lawsuit Aug. 25 in Cook County Circuit Court against Dr. Vivek Gupta and Dr. Peter Alexander Snitovsky, individually and as agents of Saints Mary and Elizabeth Medical Center doing business as St. Mary of Nazareth Hospital, and Presence Saints Mary and Elizabeth Medical Center doing business as St. Mary of Nazareth Hospital.

According to the complaint, after Iraida Aviles fell at home and broke her hip she underwent an operation at St. Mary Hospital in Chicago on Aug. 29, 2013, to repair the fracture. Two days later, while recovering at St. Mary, Aviles was found unresponsive and not breathing, the suit says. She died Aug. 31, 2013, two days after the surgery.

The suit charges the defendants with wrongful death, alleging it failed to assess Aviles’ history of heart disease and other illnesses before the operation and order a cardiological consultation.

Aviles seeks damages of more than $50,000, plus court costs. She is represented by attorneys Alex D. Abate and Alexander F. Stephens of Sutter & Ori in Chicago.
