Elderly woman’s death leads to suit against skilled nursing facility

CHICAGO – A Cook County man is suing a skilled nursing facility over a wrongful-death allegation, in a dispute surrounding his elderly mother.

Richard Theriot, special administrator of the estate of Mary Theriot, filed a lawsuit Jan. 19 in Cook County Circuit Court against Alden-Princeton Rehabilitation and Health Care Center Inc. and Alden Princeton, alleging wrongful death.

According to the complaint, Mary Theriot was admitted to Alden-Princeton in Chicago on Jan. 12, 2015, with no decubitus ulcers or skin breakdowns on her body, but was noted as being at high risk for their development. During her residency, the suit says, Mary Theriot developed a Stage IV ulcer to her sacrum and coccyx with associated osteomyelitis. After treatment, the suit says, doctors diagnosed her with a bacterial infection originating from the ulcer, which allegedly contributed to her death on May 28, 2015.

Theriot seeks a jury trial and damages in excess of $50,000. He is represented by attorneys Michael T. Mertz and Brian J. Holmes of Hurley McKenna & Mertz P.C. in Chicago.
