Label company accuses ex-worker of stealing proprietary information

CHICAGO — An Illinois firm is suing an ex-employee for allegedly breaking a confidentiality agreement after he left the company to launch a competitor.

Pamco Label Company Inc. filed a lawsuit Jan. 29 in Cook County Circuit Court against Eugenio Napolitano and Carigio Inc., alleging breach of contract.

According to the complaint, Napolitano worked for Pamco as a sales representative from January 2008 until August 2015, when he left to form his own rival firm, Carigio. While a Pamco employee, the suit says, Napolitano received extensive, specialized training and had access to proprietary information such as price lists, sales reports, sales leads/prospects and customer history information.

Pamco claims Napolitano has violated a confidentiality agreement he signed upon being hired, which prevents him from recruiting former co-workers and customers to do business with the new firm for one year after he left. The complaint also states that during his final year of employment, Napolitano conducted Pamco business on his personal laptop, which now has proprietary information stored on it.

Pamco seeks a jury trial, punitive and compensatory damages, and an injunction preventing Carigio’s interference with its business. It is represented by attorneys Dana S. Connell and Todd M. Church of Littler Mendelson P.C. in Chicago.
