Woman sues podiatrists, hospital after surgery

CHICAGO — A Park Forest woman is suing two podiatrists and a hospital in a complaint alleging that surgery resulted in chronic pain and worsened condition.

Rosalyn McDonald-Henry filed a suit on Feb. 9 in Cook County Circuit Court against Dale S. Brink, a physician at Performance Foot and Ankle Center; Ingalls Memorial Hospital; and Svend J. Bjorn, who allegedly performed surgery at Ingalls Hospital.

Court documents state that prior to February 21, 2014, McDonald-Henry had visited Performance Foot and Ankle Center complaining of pain and swelling in her left foot. McDonald-Henry was examined by Brink who had reviewed an MRI of McDonald-Henry’s left foot and ankle and diagnosed her with gastrocnemius equinus, left ankle, calcaneal valgus, left foot, and talonavicular joint arthritis with posterior tibial tendonosis, left foot, according to the suit. The lawsuit contends that It was recommended that McDonald-Henry should have surgery.

McDonald-Henry agreed to have the surgery, which was performed at Ingalls Hospital by Bjorn, the suit says. The procedure included a left foot gastrocnemius recession, left ankle; a calcaneal osteotomy, left foot; and a tendon arthrodesis with navicular prominence, left foot, according to the suit..

McDonald-Henry claims negligence on a number of counts, including: carelessly and negligently performing the left foot/ankle surgery, carelessly and negligently misdiagnosing McDonald-Henry’s condition, and carelessly and negligently performing incorrect and medically unnecessary surgeries.

The suit also states the surgery has resulted in chronic pain and the need for additional surgeries.

McDonald-Henry is seeking judgment against the defendants for an amount in excess of jurisdictional limit of the court, as well as costs concomitant herewith.
