CHICAGO — A mother is suing the organizers of a concert at the Aragon Ballroom in Chicago, alleging wrongful death after her son fell onto a catwalk, where he was impaled by protruding metal rods and died.

Denise Kirchhoff, independent administrator of the estate of her son, Kyle Kirchhoff, is suing Aragon Entertainment Center Inc., Live Nation Chicago Inc., Live Nation Marketing Inc., Live Nation LGTours (USA) LLC, Live Nation UTours (USA) Inc. and Live Nation Worldwide, citing alleged negligence.

The plaintiff filed suit March 10 in Cook County Circuit Court, alleging that the defendants failed to exercise ordinary care by ensuring that the property was reasonably safe for any use.

The suit says that on May 22, 2015, Kyle Kirchhoff was with others attending a concert when they tried to access a balcony, and went through a door they believed led to the balcony. Instead, the suit says, the door led to a catwalk, where the concert-goer and his friends stood on an elevated portion of the catwalk before Kyle Kirchhoff fell about four feet to the floor of the catwalk, where he fell onto protruding metal rods and suffered fatal puncture wounds.

The plaintiff holds the defendants responsible for allegedly failing to check the area to identify a safety hazard and failing to post signs or warnings of danger.

The plaintiff seeks compensation of more than $50,000 plus the costs of suit. She is represented by Bruno R. Marasso of Romanucci & Blandin in Chicago.
