Customer blames restaurant owner for assault, injuries

CHICAGO-  A customer is suing a Palatine restaurant and bar owner, alleging negligence for injuries he says he suffered in an assault.

Todd McCarthy filed a lawsuit March 17 in Cook County Circuit Court against Durty Nellies's, a restaurant and bar owner, alleging negligence resulting in injury.

According to the complaint, on March 20, 2015, McCarthy was assaulted by another customer resulting in numerous painful and severe injuries. The suit says the defendant allowed the presence of a quarrelsome and disorderly customer in the restaurant and was not able to control this customer.

The plaintiff seeks more than $50,000, plus the costs of suit. He is represented by attorney John J. Driscoll of Driscoll Law Offices PC in Chicago.
