CHICAGO — A man is suing a bus company and one of its drivers after a collision allegedly resulted in the death of one of the passengers.

John B. Kralovec, special administrator of the estate of Nicole Marie Underwood, filed a complaint on Jan. 13 in the Circuit Court of Cook County against Mark D. Chaney, Burlington Stage Lines LTD, doing business as Burlington Trailways.

According to the complaint, the plaintiff alleges that on Dec. 28, 2015, Underwood was a passenger on the bus driven by Chaney that crashed into a construction sign and barrier. She allegedly suffered severe injuries resulting in her death. The plaintiff holds Mark D. Chaney responsible because the defendant allegedly failed to operate the bus properly and with reasonable care to avoid accidents and to protect its passengers. The plaintiff is holding Burlington Trailways responsible because it allegedly failed to properly maintain, inspect and repair the company's bus prior to the occurrence of the accident.

The plaintiff seeks compensation for an amount in excess of $50,000, plus costs for this action. He is represented by Thomas M. Power of Power Rogers & Smith P.C. in Chicago.
