Physician accuses former associates of unlawful access

CHICAGO — A Cook County physician is suing health care providers, alleging invasion of privacy in accessing her medical records without authorization.

Dr. Maria Teresa Tam filed a lawsuit April 22 in Cook County Circuit Court against Dr. Barbara Diakos, Dr. Rose Diakos and Lakeshore Women's Health Specialists SC, alleging they knowingly violated the Health Insurance Portability and Accountability Act and Illinois Medical Patient Rights Act. 

According to the complaint, Tam has suffered severe anguish and stress caused by the intrusion of her privacy. The plaintiff alleges the defendants accessed her electronic medical records intentionally and maliciously without authorization when Tam was at Lakeshore as an inpatient May 18-25, 2014.

Tam seeks a trial by jury and more than $30,000, plus attorney fees and the costs of suit. She is represented by attorney Leslie Anne Rojas of The Health Law Partners PC in Southfield, Michigan.
