CHICAGO – An insurance company has filed a suit against a Downers Grove construction company alleging that its employees' negligence caused a house fire.

Hanover Insurance Co., as a subrogee of Elias Papadimas, filed a complaint on April 5 in Cook County Circuit Court against CEK Builders Inc., citing negligence, breach of contract and breach of express warranty.

According to the complaint, the plaintiff alleges that it has suffered damages by paying Elias Papadimas in the amount of $319,604.46, for the expenses that arose from a fire at his Wilmette residence on Aug. 12, 2014. The plaintiff holds CEK Builders Inc. responsible because the defendant allegedly was contacted by Papadimas to conduct renovations on his residence and the defendant through its employees negligently failed to properly dispose of stain-soaked rags that were left on the floor, which led the rags to spontaneously combust, resulting in the fire.

The plaintiff requests a trial by jury and seeks judgement against the defendant in the amount of $319,604.46, attorney's fees and costs and for such other relief as the court may deem just and equitable.
