Consumer alleges Quaker Oats misrepresents oatmeal items

CHICAGO — A Dolton consumer is suing Quaker Oats, alleging negligent misrepresentation of its oatmeal cereals.

Sabrina Wheeler of Dolton, individually and on behalf of all others similarly situated, filed a lawsuit May 2 in Cook County Circuit Court against The Quaker Oats Company, alleging negligent misrepresentation because of claims that their oatmeal products are 100 percent natural.

According to the complaint, Wheeler was damaged as a result of falsely labeled products. The plaintiff alleges Quaker Oats advertised its products to be 100 percent natural but, upon inspection, the products contains glyphosate, a herbicide that may be harmful for humans.

Wheeler seeks a trial by jury, full restitution, an order to advertise the product properly including a recall of the products, an order to disgorge all ill-gotten gains, all damages, interest, all legal fees and any other relief the court deems just.
