CHICAGO – An estate executor alleges that a health care facility failed to protect her decedent from falls.

Karen Kemmer, as executor of the estate of Mary Skurka filed a complaint on May 20 in Cook County Circuit Court against Affordable Community Housing Trust-Epsilon, doing business as Waterford Estates and Triad Senior Living Inc., citing wrongful death.

According to the complaint, the plaintiff alleges that on Dec. 30, 2015, Skurka fell and suffered injuries that resulted in her death on Jan. 4. The plaintiff holds Affordable Community Housing Trust-Epsilon responsible because the defendant allegedly failed to properly evaluate Skurka's fall risk, failed to institute fall precautions and other counts.

The plaintiff seeks judgment against the defendant in such amount in excess of this court's jurisdiction enough to compensate plaintiff. She is represented by Michael F. Sullivan of Sukhman Yagoda in Chicago.
