Daughter alleges long-term care facility caused mother's death

CHICAGO — A daughter is suing an Orland Park long-term health care facility, alleging its negligence caused her mother's death. 

Linda Shrout, as independent administrator of the estate of Josephine Liby, her mother, filed a lawsuit June 6 in Cook County Circuit Court against Lexington Health Care Center of Orland Park Inc., doing business as Lexington of Orland Park and Royal Management Corporation, alleging insufficient measures were taken to prevent injuries. 

According to the complaint, on July 16, 2014, Liby sustained physical injuries when she fell and was found lying on the floor of her room, which caused or contributed to her death Oct. 3, 2014. The plaintiff alleges the defendants failed to provide proper accommodations, proper care and supervision to Liby despite knowing her condition upon her admission to the facility July 11. 2014.

Shrout seeks judgment of more than $50,000. She is represented by attorneys Jordan S. Powell and Michelle L. Wesley of Levin & Perconti in Chicago.
