Man files suit for return of money used to buy property, alleging fraud

CHICAGO – A man alleges fraud in the purchase of a Chicago property.

Mark Borniak filed a complaint on April 4 in Cook County Circuit Court against Shoei Co. LTD and Frystak Associates Inc., Frank Frystak, North Shore Trust and Savings Bank and Joseph Putnick alleging that they made false representation to plaintiff in order for him to transfer the funds earlier than the said date for the purchase of property.

According to the complaint, the plaintiff alleges that he suffered monetary damages of $200,775. The plaintiff holds the defendants responsible because the defendants allegedly made false representations to plaintiff regarding the transfer of funds for the purchase of a property in 2015.

The plaintiff seeks judgment against the defendants in the amount of $200,775 plus interest, punitive damages, all court costs and any further relief this court grants. He is represented by Steven J. Rotunno and Katelyn Quimby of Miller, Canfield, Paddock and Stone PLC in Chicago.
