CHICAGO – A man alleges he was wrongfully charged with a crime after his stay in an Elmhurst hospital.

Carey J. Nuyen filed a complaint on March 8 in Cook County Circuit Court against Elmhurst Memorial Hospital, also known as Elmhurst Memorial Healthcare, Imelda Hanson, Barbara Martynko, Kelsey Herbert, Catherine Archibald and Kimberly Urbnek alleging malicious prosecution and intentional infliction of emotional distress.

According to the complaint, Nuyen was charged with disorderly conduct after the defendants reported to police a phone conversation they overheard him having while he was at the hospital for hip replacement surger in 2013. The suit states he was later placed on house arrest. The plaintiff alleges that he suffered physical and emotional damages as well as permanent disfigurement and pain as a result of being denied to attend his physical therapy session and being charged with criminal offense.

The plaintiff holds the defendants responsible because the defendants allegedly falsified information used in police reports and fabricated evidences in order for plaintiff to be charged with criminal charges.

The plaintiff seeks judgment against the defendant in an amount in of more than $100,000 for compensatory and punitive damages plus court costs and any further relief granted by this court. He is represented by Stuart A. Petersen of Ruddy and King LLC in Aurora.
