Man says nursing home didn't prevent fall

CHICAGO — A resident is suing Evergreen Living & Rehab Center LLC, d/b/a The Villa at Evergreen Park, a nursing care facility, alleging negligence and insufficient measures taken to prevent injuries.

Thomas Whitby filed a complaint on June 17 in Cook County Circuit Court against Evergreen Living & Rehab Center LLC, d/b/a The Villa at Evergreen Park, alleging that the nursing care facility failed to provide him with proper care.

According to the complaint, the plaintiff alleges that on Jan. 18, he sustained physical injuries when he fell. The plaintiff holds the defendant responsible for allegedly failing to provide adequate supervision at all times to the plaintiff while knowing that he is at risk of falling, as well as failing to a have comprehensive care plan that would prevent him from falling.

The plaintiff seeks judgment against the defendant in an amount in excess of $50,000 plus court costs. He is represented by Jeffrey A. Schulkin of Jeffrey M. Goldberg Law Offices in Chicago.
