Nursing home accused of failure to supervise

CHICAGO — A man with power of attorney for his father is suing Lexington Health Care Center of Chicago Ridge Inc., d/b/a Lexington Center-Chicago Ridge, a nursing care facility, alleging negligence and insufficient measures taken to prevent injuries.

Don Wellington, as power of attorney of Herbert L. Wellington, filed a complaint on June 30 in Cook County Circuit Court against the defendant, alleging that the nursing care facility failed to provide proper care to Herbert L. Wellington.

According to the complaint, the plaintiff alleges that in July 2014, Herbert L. Wellington fell, causing pain, injuries and a hip fracture that required surgery. The plaintiff holds the defendant responsible because it allegedly failed to provide adequate supervision at all times as well as failing to properly treat Herbert Wellington's broken hip.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $50,000 plus court costs. He is represented by Michael E. Holden and Rebecca E. Neubauer of Romanucci & Blandin, LLC in Chicago.
