CHICAGO — A woman is suing Idant Laboratories, Daxor Corporation, Invia Fertility Specialists, Karande & Associates S.C. and Does 1-25, alleging that her two children conceived with donor sperm both have autisum and that she deserves compensation for battery, breach of warranty, fraud, negligence, negligent misrepresentation and product liability.

Danielle Rizzo filed a complaint on July 21 in Cook County Circuit Court against the defendants, alleging that they sold her defective sperm.

According to the complaint, the plaintiff alleges that she suffered damages as the result of being buying human sperm from which her children inherited autism. The plaintiff holds the defendants responsible for allegedly failing to properly screen the sperm donor.

The plaintiff seeks judgment against the defendant in an amount in excess of $50,000 plus any further relief this court grants. She is represented by John R. Ostojic and Lauren Crissie of Ostojic & Scudder LLC in Chicago and Nancy Hersh and Brendan Gannon of Hersh & Hersh in San Francisco.
