Woman alleges injuries in connection with repossession

CHICAGO — An individual is suing Barnes Used Cars Inc., d/b/a Barnes Auto Group, citing alleged vicarious liability.

Idella S. Brown filed a complaint on Aug. 8 in Cook County Circuit Court against the defendant, alleging that the company is responsible for injuries she suffered when tow operators sent by the defendant attempted to repossess the vehicle while she was inside it.

According to the complaint, the plaintiff alleges that in September 2014, she sustained physical injuries after two men tried to open the vehicle while she was sleeping in it. She claims she was scared and drove away, after which the tow operators drove their truck into her car and forcibly removed her from the car, causing injuries.

The plaintiff seeks judgment against the defendant in an amount in excess of the jurisdictional limit of the court plus court costs. She is represented by Alan H. Bender of Goldstein Bender & Romanoff in Chicago.
