Woman claims negligence in choice of hip implant

CHICAGO — A patient is suing Midwest Sports Medicine & Orthopaedic Surgical Specialists Ltd. and Dr. Eugene P. Lopez, alleging negligence in medical care.

Susan Hermes filed a complaint on Aug. 12 in Cook County Circuit Court against the defendants, alleging that they failed to provide her with proper medical care.

According to the complaint, the plaintiff alleges that she sustained permanent injuries as a result of surgery in 2013. The plaintiff holds the defendants responsible for a left hip surgery in which a Birmingham implant was allegedly used despite indications that it would be hazardous according to her medical profile and for allegedly failing to properly evaluate her health for possible toxicity from cobalt and chromium particles after the implant was placed.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $100,000. She is represented by Mark P. Munninghoff of Munday & Nathan in Chicago.
