Woman says cemetery should pay after she was hurt by fallen gravestone

CHICAGO — A woman is suing The Catholic Bishop of Chicago and Our Lady of Sorrows Cemetery Care, NFP, alleging they should be held responsible for her injuries from a falling headstone.

Elaine Kovats filed a complaint on Aug. 24 in Cook County Circuit Court against the defendants alleging that they failed to properly maintain a gravestone on their property.

According to the complaint, the plaintiff alleges that on Oct. 27, 2014, she was visiting Our Lady of Sorrows Cemetery when a headstone tipped over and fell on her leg, injuring her. The plaintiff holds the defendants responsible because they allegedly failed to properly secure the gravestone.

The plaintiff seeks judgment against the defendants of more than $50,000 plus court costs. She is represented by Michael A. Knobloch of Goldberg Weisman Cairo in Chicago.
