Gas station owners accused of not fixing crack in pavement which caused trip and fall

CHICAGO — A woman says cracked pavement at a gas station caused her to trip and fall.

Sandra Melgar is suing E&D Citgo, Inc.; St. George Oil Group, Inc. d/b/a Nagle Citgo; Nagle Station, LLC; Maev, LLC d/b/a Nagle Gas Station; Evripidis Gogos; and Jibit Joy, alleging negligence, liability and insufficient measures taken to prevent injuries. She filed a complaint on Sept. 15 in Cook County Circuit Court against the defendants, alleging that they failed to properly maintain the pavement of their property.

According to the complaint, the plaintiff alleges that on Sept. 18, 2014, she sustained physical injuries when she tripped and fell due to a crack in pavement. The plaintiff said the defendants allowed the hazardous condition of the pavement on their property and didn't provide adequate warning regarding the condition of the pavement.

The plaintiff seeks judgment against the defendants in an amount sufficient to satisfy the jurisdictional limitation of the court, court costs and any further relief the court grants. She is represented by Scott H. Rudin and Adam Budz of Miroballi, Durkin & Rudin, LLC in Chicago.
