CHICAGO — A man is suing Loyola University Health System, alleging intentional infliction of emotional distress, retaliation, violation of the Family and Medical Leave Act and wrongful termination, after he says his former employers fired him for attempting to take medical leave to treat leukemia.
John Zinkel filed a complaint on Sept. 30 in Cook County Circuit Court against Vicky Piper, Pradipta Komanduri, Carolyn Nelson and Loyola University Health System, alleging that the defendants terminated his employment for exercising his rights to FMLA.
According to the complaint, the plaintiff alleges that he had to go on FMLA leave due to work stress exacerbating his leukemia, and that he was told he would be terminated after his leave expired. The plaintiff holds the defendants responsible for allegedly terminating his employment as retaliation.
The plaintiff requests a trial by jury and seeks compensatory damages, punitive damages and any further relief the court grants. He is represented by Ruth I. Major and Daniel R. Broadwell of The Law Offices of Ruth I. Major. PC in Chicago.
