Midway Neurological and Rehabilitation Center allegedly failed to prevent fall, femur fracture

CHICAGO — A representative of the estate of a disabled patient is suing Midway Neurological and Rehabilitation Center LLC for allegedly taking insufficient measures to prevent the patient from falling and fracturing her femur.

Darien Colbert, plenary guardian of the estate and person of Claudette Lacey, filed a lawsuit on March 16 in Cook County Circuit Court alleging the nursing facility failed to provide Lacey with proper care.

According to the complaint, the plaintiff alleges Lacey experienced pain after suffering a fall. The plaintiff holds the defendant responsible for allegedly failing to adequately supervise Lacey to address her risk of falling.

The plaintiff seeks judgment against the defendant in an amount greater than $50,000. He is represented by Warren E. Abrahamson of Sandman, Levy and Petrich LLC in Chicago.
