Construction union says SWS Services delinquent on benefit fund contributions

CHICAGO — A construction workers' labor group is suing SWS Services LLC, an employer, citing alleged breach of contract.

The Construction and General Laborers' District Council of Chicago and its pension and welfare funds, and James S. Jorgensen, fund administrator, filed a complaint on March 28 in the U.S. District Court for the Northern District of Illinois alleging the contractor failed to remit its required contributions to the union funds.

According to the complaint, the plaintiffs allege they sustained damages due to unpaid and late benefits contributions. The plaintiffs hold SWS responsible because it allegedly breached its agreement with the labor group by failing to remit the contributions as required by collective bargaining agreement.

The plaintiffs seek judgment against the defendant for the amounts of contributions, liquidated damages, court costs, and any further relief this court grants. They are represented by Karen I. Engelhardt, Sara S. Schumann and Rayn M. Thoma of Allison, Slutsky & Kennedy P.C. in Chicago.
