BDP International claims competitor adopted nearly identical business name

CHICAGO — A Pennsylvania-based logistics firm is suing BDP International Enterprises Inc., based in Orland Park, and owner Brandon Pennington, alleging unfair competition.

BDP International Inc. filed a complaint on May 2 in U.S. District Court for the Northern District of Illinois against the defendants alleging they used plaintiff's trademarks to sell their competing services.

According to the complaint, the plaintiff alleges its trademark was used to advertise services that are similar to their offerings. The plaintiff holds BDP International Enterprises Inc. and Pennington responsible because the defendants allegedly caused confusion to consumers by advertising their similar services under a nearly identical trade name as the plaintiff's.

The plaintiff requests a trial by jury and seeks injunction against the defendants, the destruction of all infringing materials under the defendants' possession, the payment of profits and damages sustained by the plaintiff, interest, court costs and any further relief this court grants. They are represented by Joseph E. Collins of Fox Rothschild LLP in Chicago.
