Auto collision lawsuit accuses driver of running red light at intersection of Division Street and Homan in Chicago

CHICAGO – A woman has filed a negligence lawsuit, claiming that she was injured when a driver ran a red light at the intersection of Division Street and Homan in Chicago and collided with her vehicle.

According to court documents filed in Cook County Circuit Court, on Dec. 9, 2023, Angelina Gutierrez, the plaintiff, was driving westbound on Division Street near the intersection of Homan when her vehicle was struck by the defendant, Rasean V. Cummins. Cummins was allegedly driving southbound on Homan Avenue when he entered the intersection during a steady red light signal. At the time of the collision, Cummins was operating a vehicle provided by his employer, Hertz Vehicles LLC, and was acting within the scope of his employment.

Cummins is accused of several acts of negligence, including failing to decrease his vehicle's speed to avoid collision, failing to keep his vehicle under proper control, failing to use reasonable precaution to avoid collision, failing to keep a proper lookout, failing to maintain his vehicle's brakes in working order, and driving at a speed greater than what was reasonable for the conditions.

Gutierrez claims to have suffered personal and pecuniary injuries as a result of the defendants' collective negligence. She is seeking damages in excess of $50,000 plus court costs.
