The lawsuit filed by Mark Kashirsky and Jame Kashirsky against Presence Central and Suburban Hospitals Network, Alexian Brothers-AHS Midwest Regional Health Co., Cary R. Templin, M.D., Stacy R. Baker, R.N., and Hinsdale Orthopedic Associates was held in the Appellate Court of Illinois, First Judicial District under case ID 1-23-0060 on March 29, 2024. The case revolves around an alleged medical malpractice incident that resulted in serious permanent injuries to Mark Kashirsky due to a medication interaction that was not properly explained.

Mark Kashirsky underwent back surgery at AMITA Health Saint Joseph Medical Center in Joliet on July 17, 2019. Post-surgery, he suffered from an "anoxic event at his home" which led to permanent neurological, cognitive, physical, emotional, and psychiatric effects due to a lack of oxygen. This was allegedly caused by a failure on the part of the defendants to properly explain a potential interaction between his pain medication and another drug he was taking.

The plaintiffs filed their medical malpractice suit against the defendants on July 16, 2021. In December 2021, several defendants moved to transfer the case from Cook County to Will County for convenience reasons. However, after discovery and arguments were presented by both parties regarding the convenience of litigating in Cook County versus Will County, the court denied the motion to transfer.

The plaintiffs are seeking judgment for medical malpractice resulting from negligence in administering and advising about pain medication leading to serious permanent injuries. They allege that this negligence took place at AMITA Health Saint Joseph Medical Center where Mark's back surgery was performed.
