Tubuka Evans sues Prode for sex/gender-based and race-based harassment and discrimination

In the United States District Court, Northern District of Illinois, Tubuka Evans has filed a lawsuit against Prode, Inc. d/b/a Jiffy Lube #238 under case ID 1:24-cv-03245 on April 23, 2024. The plaintiff alleges sex/gender-based harassment and discrimination, race-based harassment and discrimination, and retaliation for engaging in protected activity under Title VII of the Civil Rights Act of 1964.

Represented by his counsel, Evans claims that he experienced increasing harassment after the passing of his manager named Chris. He details an incident on January 11, 2023, when his co-workers began to ridicule him for identifying as non-binary. Despite explaining his gender identification and requesting to be referred to as "TJ", the situation worsened with offensive remarks being made about him.

The plaintiff further alleges that he was subjected to different terms and conditions of employment compared to others not within their protected class. He claims that he was taken off the schedule on January 15, 2023, but was later reinstated with reduced hours in February 2023 after expressing discomfort working with specific co-workers.

Evans is seeking redress under Title VII of the Civil Rights Act of 1964 for the alleged sex/gender-based harassment and discrimination, race-based harassment and discrimination, and retaliation.
