Machinist alleges equipment makers caused electrocution

A Kane County machinist has sued a Chicago corporation and a Connecticut business, alleging negligence in a 2013 accident.

Marc Vargas of Hampshire filed a lawsuit May 26 in Cook County Circuit Court against Charter Steel Trading Co. Inc. of Chicago, and Terex Corporation, doing business as Demag Cranes of Westport, Connecticut, alleging liability in a 2013 injury.

The suit states Vargas was employed by Iron-Horse Cranes Inc. as a sales and service professional, and Iron-Horse was contracted to perform work at Charter Steel’s premises. According to the complaint, on Aug. 8, 2013, when Vargas performed maintenance work on an indoor overhead crane on the premises, the switch panel was mis-wired and the plaintiff received an electric shock.

The plaintiff cites both defendants for negligence and/or liability, and alleges: a dangerous condition created by the improper wiring; and negligence in failing to inform personnel of the hazard and take actions to make the work environment free of hazard, along with defective crane manufacture and installation.

Vargas seeks compensation in excess of $50,000, plus interest, attorney fees and costs. He is represented by attorneys Stephan Blandin, Michael Holden and Erin Calandriello of Romanucci & Blandin in Chicago.
