Pedestrian blames trucking firm, driver for injuries

A Cook County man has sued a trucking firm and its employee, alleging vehicular negligence.

Gary M. Marine filed a lawsuit May 26 in Cook County Circuit Court against Damien Salazar, individually and as an agent for E.B. Truck Inc.; and E.B. Truck Inc. alleging vehicular negligence in a 2013 accident.

According to the complaint, on Sept. 18, 2013, Marine was standing in the parking lot of the Melrose Park police station, 1 N. Broadway St., when Salazar, driving a motor vehicle belonging to E.B. Truck in a westbound direction in the parking lot, struck the plaintiff with the vehicle. The suit states Salazar was acting in the scope of his employment with E.B. Truck at the time of the accident.

The complaint cites both defendants for: careless and negligent operation of the vehicle; failing to keep a proper lookout; operating the vehicle without adequate brakes and at a higher than reasonable speed for traffic circumstances; and failing to give audible warning to the pedestrian.

Marine seeks damages from each defendant in excess of $50,000, plus attorney fees and costs. He is represented by attorney Brian Carey of Melrose Park.
