Menard's blamed for child's injury

A Cook County mother is suing Menard's after her daughter allegedly was injured in a store accident.

Molly Hugen filed a lawsuit on behalf of minor Tessa Hugen June 10 in Cook County Circuit Court against Menard Inc., alleging premises liability.

According to the filing, on May 3, Tessa Hugen was at the Menard's store at 2601 N. Clybourn Ave., Chicago, when she walked down a store aisle near boxes of dog crates that had been stacked without supporting shelving. The crates fell, injuring Hugen.

The suits says Menard's breached its duty to keep the premises safe for the public by failing to secure items on shelves to prevent them from falling; neglected to maintain and upkeep the premises; and overlooked the need to provide a warning to customers about the possibility of falling objects.

The plaintiff says as a direct and proximate result of the defendant’s wrongful acts or omissions, her daughter was: severely injured; suffered pain and disability; and will continue to require medical care. She alleges anticipated future economic damages due to continued medical expenses and loss of wages.

Molly Hugen seeks damages in excess of the jurisdictional amount, plus attorney fees and costs. She is represented by Daniel Stanton of Cooney & Conway in Chicago.
