Daughter claims wrongful death, sues nursing home

A Cook County resident filed suit against a nursing home and its owners claiming violation of the Illinois Nursing Home Care Act in her mother’s 2013 death.

Cordell Jones-Sroka, as estate administrator for Cecelia Jones, deceased, sued The Villa at South Holland LLC, doing business as The Villa at South Holland; Villa Healthcare Management Inc., doing business as Villa Healthcare; Raphaela Stern; Menachem Berger; and Benjamin Israel in Cook County Circuit Court on June 19, alleging negligence in a June 2013 incident that she claims led to her mother’s August 2013 death.

According to the filing, Cecelia Jones, 77, was taken to a hospital following a stroke in spring 2013 and transferred to The Villa at South Holland at 16300 Wausau Ave. in South Holland. Court documents indicate that when family members visited Jones on or about June 24, 2013, the patient had bruising and swelling including two black eyes; she allegedly expressed fear and wanted to leave the facility.

Staff allegedly said she had fallen and been taken to a hospital for imaging studies, which the plaintiff was told showed no internal injuries. Cordell Jones-Sroka alleges that she took her mother for additional CAT scans, which purportedly revealed a dangerous blood clot in her leg.

Following the additional studies, Cecelia Jones was transferred to another facility. The suit states that as a result of her injuries and complications, she died on Aug. 27, 2013; and that the decedent’s injuries were a direct and proximate result of the defendant’s negligent acts or omissions.

The plaintiff seeks compensatory damages in excess of $50,000 for her mother’s disfigurement, disability, pain and suffering, along with medical expenses, attorneys’ fees and costs. She is represented by Nnanenyem E. Uche of Chicago.
