Edward Hospital, doctors sued over allegedly missing brain damage signs

A hospital and several doctors are being sued for allegedly overlooking critical brain damage during a boy's emergency room visit.

Mike and Dana Patterson, parents of Mason Patterson, filed a complaint June 26 in Cook County Circuit Court against Edward Hospital, physicians Michael Mitchell and Paul Backas,, Naperville Radiologists SC, Presence Hospitals, Presence St. Joseph Medical Center, Dr. Sasan Payvar and Joliet Radiological Service Corp.

On May 11, 2010, the plaintiff went to the Edward Hospital emergency room with a head injury, complaining of a headache and dizziness. He underwent a CT scan, the lawsuit states, but what was clearly a brain arteriovenous malformation (AVM) was not recognized.

The plaintiffs allege the defendants failed to diagnose the AVM or the vascular abnormality, notify the emergency room about the abnormality, investigate the abnormality, notify the patient and his parents about it, and ensure the plaintiff was quickly referred to a neurosurgeon.

As a result, the lawsuit states, the plaintiff's AVM went undiagnosed and untreated until it ruptured on Nov. 4, 2013, causing the plaintiff to suffer permanent brain injuries and disability.

The plaintiffs, citing medical negligence, seek damages of more than $3 million, plus costs.

The plaintiff is represented by Mark W. Mathys and Mark T. Schneid, of the Law Offices of Mathys and Schneid, of Naperville.
