Compassionate Home Care sues former employee

A home health care provider is suing a former employee over claims she wrongly disclosed information and solicited patients.

Compassionate Home Care Inc. filed a lawsuit Nov. 14 in the Circuit Court of Cook County against Kimberlee Buroff, formerly known as Kim Moraga, and Holy Mary Home Health Care Inc., citing breach of the duty of loyalty, breach of contract and violation of the Illinois Trade Secrets Act.

The plaintiff alleges that it employed Buroff as a visiting nurse to provide home health services from June 19, 2007 until Oct. 3, 2013.

The suit states that as a condition of employment, Buroff entered into a Nurse Services Agreement, which prevented her from the unauthorized disclosure of patient information and soliciting patients.

The plaintiff contends that while Buroff was still employed by Compassionate Home Care, she began informing patients she was leaving to go work for Holy Mary and solicited them to engage Holy Mary to provide home health services.

Buroff, the suit asserts, improperly disclosed patient information to Holy Mary in violation of the Nurse Services Agreement, as well as the Health Insurance Portability and Accountability Act (HIPAA).

Compassionate Home Care is seeking an undisclosed amount in damages and is being represented by Buzogany & Associates LLC.
