Aberdeen Construction sued for allegedly causing damage during renovation

A store is suing a construction company over claims it caused damage to the store during renovations.

The Travelers Indemnity Company of America, as a subrogee of Yolanda Lorente Ltd., filed a lawsuit Dec. 10 in the Cook County Circuit Court against Aberdeen Construction Co. Inc., citing property damage.

According to the complaint, Yolanda Lorente Ltd. had a retail woman's clothing store at 1825 W. Newport St. in Chicago, which was sold to Newport LLC on May 19, 2011.  They executed a commercial lease agreement, in which Lorente leased the property from Newport.

During the spring and summer of 2011, the suit states Newport hired Aberdeen to renovate and that Aberdeen then breached its duty by failing to obtain a building permit from the city and remove an acoustic ceiling, which had been installed underneath the 70-year-old crack-filled wooden floorboards and separated the first and second floors.

The plaintiff is seeking damages in the amount of $323,342.16, plus costs and attorneys fees. It is being represented by attorney Robert J. Spinazzola of Maisel & Associates.
