Bank sues over alleged fraud, negligent misrepresentation

A bank is suing, claiming a DuPage County resident fraudulently procured a line of credit.

Ridgestone Bank filed a lawsuit Dec. 9 in the Cook County Circuit Court against Sunil Srivastava, also known as Sunil K. Srivastava, citing fraud and negligent misrepresentation.

According to the complaint, Aug. 29, 2007, Sunil submitted a personal financial statement to Ridgestone Bank in an attempt to procure a line of credit. The bank claims in exchange for funding the line of credit, it was to receive a valid first mortgage lien interest in the defendant's property.

The bank asserts Sunil falsely represented the property was free and clear of all liens when he knew the property had a Chase Note and Mortgage. The bank contends it reasonably relied on Sunil's representations when it agreed to fund the line of credit, but would not have done so had it been aware of the mortgage.

Ridgestone Bank is seeking no less than $978,962.44, plus costs and is being represented in the case by Nathan B. Grzegorek of Larson & Associates P.C..
