Depuy faces another suit over hip replacement system

A man is suing over claims his artificial hip replacement malfunctioned, causing substantial injury.

Dale Otto filed a lawsuit Nov. 15 against Depuy Orthopaedics Inc. and Premier Orthopaedic Sales Inc., citing strict product liability, negligence and breach of warranty.

According to Otto, he was implanted with an artificial hip replacement system that was designed, manufactured, marketed, sold and distributed by Depuy and Premier has been the exclusive sales agent and distributor for the hip replacement system at issues.

The complaint alleges that the hip replacement product was defective and malfunctioned after being implanted, causing injury to Otto.

He is seeking damages in excess of jurisdictional minimum andis being represented in the case by attorney Peter J. Flowers and Thomas D. Murray of Meyers & Flowers.
