A man is suing after he was injured after slipping and falling on ice.
Vito Guarino filed a lawsuit Jan. 16 in the Cook County Circuit Court against the village of Elk Grove and North Star Trust Co., as trustee for Trust No.06-10053, citing willful and wonton and negligence.
According to the complaint on Jan. 23, 2013, Guarino sustained serious injury when he slipped and fell on ice that formed from water leaking out of a fire hydrant at 225 N. Arlington Heights Road, in Elk Grove. The defendants allowed an unnatural amount of water to leak out of the hydrant, failed to properly remove the leaking water, failed to inspect the hydrant and failed to warn, which caused the plaintiff's injury, according to the complaint.
Guarino is seeking damages in excess of the jurisdictional minimum. He is being represented in the case by attorneys Melanie J. VanOverloop and Brian D. Teven at Anesi, Ozmon, Rodin, Novak & Kohen Ltd.
