TJ Maxx and Red Monkey sued after woman falls, unborn child dies

A Chicago resident is suing after she fell while sitting on a chair, which allegedly caused her unborn child to die.

Jasmine Taylor, individually and as special administrator of the Estate of Laila Jai Jackson, filed a lawsuit Jan. 23 in the Cook County Circuit Court against TJX Companies Inc., doing business as TJ Maxx, and Red Monkey LLC, citing product liability, negligence, premise liability and breach of warranty.

The complaint states Jasmine Taylor visited the TJ Maxx at 4971 Cal Sag Road in Crestwood on July 23, 2012 and was considering purchasing a green chair in the store. When she sat on the chair manufactured by Red Monkey, the suit states, it broke, causing her to strike the floor.

Taylor asserts she was pregnant at the time of the incident and after she fell, began feeling pain and visited the hospital. According to the complaint, a Aug. 3, 2012 medical exam showed Taylor's unborn child no longer had a viable heartbeat and in-utero fetal death had occurred.

The plaintiff contends the defendants' actions or omissions caused her to fall out of the chair, which resulted in the death of her unborn child.

She is seeking damages in excess of the jurisdictional minimum and is being represented in the case by Sturgis E. Chadwick III of Chadwick & Lakerdas.
