Mazda sued after vehicle catches fire, damaging home; case settled, dismissed

UPDATE: Cook County court records indicate this case was settled and dismissed by stipulation or agreement on July 2, 2015. 

A couple is suing over claims its house was damaged by a fire that started in its car.

Andrea and Brian Clauss filed a lawsuit March 5 in the Cook County Circuit Court against Mazda Motor of America Inc., citing property damage.

According to the complaint, on Sept. 1, a fire started in the electric distribution panel of the Clauss' Mazda and then spread to their home.

They purchased the Mazda in 2012 and no work had been done on the vehicle's electric distribution panel since its purchase, the suit states. The couple accuses Mazda of breach of implied warranty and strict product liability.

Andrea and Brian Clauss are seeking more than $100,000 in damages and are being represented in the case by attorney Paul T. Falk and Anne P. MacMillan of Falk Metz LLC.
