A public utility company is suing over claims another company negligently hit its cables and conduits while excavating.
Commonwealth Edison Co. filed a lawsuit April 18 in the Cook County Circuit Court against American Underground of Ill. LLC, citing negligence, the Illinois Underground Utility Facilities Damage Prevention and Interference with Utility Services acts.
According to the suit, the defendant was involved in an excavation project at 4200 S. Sacramento Ave. in Chicago on July 18, when it damaged one of ComEd's cables and conduits. ComEd claims the defendant failed to take the necessary precautions to ensure it wouldn't damage the utilities.
ComEd is seeking damages in the amount of $257,898.18 and court costs. It is being represented by Larry S. Kowalczyk and Megan K. Monaghan of Querrey & Harrow Ltd.
