Owners of Loop shopping mall seek $100K from construction company; claim glass panels spontaneously shattered

A company is suing over claims a contractor installed defective glass in the North State Street shopping mall known as Block 37.

108 North State Street Owner LLC filed a lawsuit May 9 in the Cook County Circuit Court against W.E. O'Neil Construction Co., citing property damage.

According to the complaint, the plaintiff contracted with W.E. O'Neil in March 2009 to furnish and install glass panels in the shopping mall. The plaintiff claims after installation, the glass began to spontaneously shatter, causing glass shards to fall onto the mall floors below and damage escalators, other glass panels and handrails.

The plaintiff contends it was forced to replace the glass panels after the defendant refused to do so. The company accuses W.E. O'Neil of negligence, breach of contract and breach of implied warranty of merchantability.

It is seeking more than $100,000 in damages and is being represented by attorneys Christopher M. Heintskill and Elizabeth B. Vandesteeg of Levenfeld Pearlstein LLC.
