Suit: Comcast, spa employees hit man with baseball bat over Oak Park parking space

Comcast and a now-closed suburban spa are facing a lawsuit over claims their employees assaulted a man during a confrontation over a parking space in a Chicago suburb.

Jason B. Weimer filed suit June 26 in Cook County Circuit Court against Comcast Corp., Fabian Torres, Spa Constantine IL Inc. and Krystal Ocegueda.

According to the complaint, Weimer was attempting to park in a parking lot space at 128 N. Marion St. in Oak Park on May 28, 2013, when a van owned by Comcast and operated by Torres took the spot.

Weimer alleges he was attempting to park in order to go to his place of employment at 134 N. Marion St., An online search lists that address as a Cold Stone Creamery, although it is unclear whether the ice cream shop was located there at the time of the incident.

The suit states Weimer encountered Torres and Ocegueda, who the suit lists as an employee of the apparently now-closed Spa Constantine, in the parking lot and a dispute over the space ensued between the three.

Weimer contends Torres and Ocegueda then assaulted, battered, kicked and struck him with a baseball bat.

As a result of the incident, Weimer claims he suffered injuries, incurred medical costs, lost time and money, and has been prevented from and will continue to be unable to attend to his usual affairs and duties.

Weimer's suit, which includes counts alleging assault, battery, negligence and intentional tort, seeks compensatory and punitive damages. He is represented by Chicago attorney John J. Budin of Budin Law Offices.
