Operators of Dunkin Donuts in Polk Pink Line station face breach of contract suit

A Cook County company is suing over claims the operators of a Dunkin Donuts have breached a license agreement.

First Equity Property-Polk LLC filed a lawsuit Aug. 22 in the Cook County Circuit Court against Jamie C. and Jamie P. Dejuras.

According to the complaint, First Equity Property entered into a license agreement with the defendants in 2004 for them to operate a Dunkin Donuts franchise at the Pink Line station on West Polk Street.

The agreement was extended in November, when First Equity Property claims additional terms were added in which the defendants agreed to pay it $100,000 if they or anyone on their behalf applied to the Chicago Transit Authority to rent a property currently occupied by Dunkin Donuts.

The complaint claims the defendants had another party submit an application to the CTA on their behalf to lease the space and were awarded the right to lease the property from the CTA, instead of First Equity.

The company claims the defendants breached their agreement and have no paid them the $100,000 as required under the extension.

First Equity Property is seeking more than $100,000 and is being represented in the case by attorneys Marty J. Schwartz and Tyler Manic of Schain Banks Kenny & Schwartz in Chicago.
