Two business owners claim Danny's Roofing & Remodeling failed to perform work

Two Cook County business owners are suing over claims a contractor failed to perform agreed upon remodeling work after a fire.

Rizeg Aburizeg and Miguel Guadalupe filed a lawsuit Oct. 14 in Cook County Circuit Court against Daniel Hermasillo, Carlos Hermasillo and Silvia Guerrero, individually and collectively doing business as Danny's Roofing & Remodeling, alleging negligence and breach of contract.

According to the complaint, a fire occurred at Aburizeg's building on West 111th Street in Worth on Sept. 16, 2013, and she obtained a $45,000 estimate for repairs from Danny's Roofing & Remodeling.

Aburizeg claims she made a $25,000 payment and then a $15,000 payment to Guerrero, but the defendants performed less than 20 percent of the work agreed upon in the contract, failing to replace the restrooms, electrical work and roof, among other things.

She further alleges a worker backed a truck into the building's awning, causing damage requiring it to be placed, and that the defendants' breach of contract forced her to buy new materials and hire new contractors.

In addition, the complaint states Guadalupe, a tenant of Aburizeg's who operates Michael's Pancake House, contracted the defendants on March 31 for a $20,000 kitchen remodeling and installation of a fire suppression system. He contends none of the work was performed.

Aburizeg is seeking more than $45,000 in damages from the defendant company, and $15,000 from Guerrero. Guadalupe is seeking $17,800 in damages, plus attorneys fees. They are represented by attorney David R. Sweis of Sweis Law Firm of Oak Brook.
