Customer sues Menards, says was hurt by falling pile of insulation

A Cook County man has sued Menards, alleging he was hurt when a stack of insulation fell on him at the home improvement retailer's Hodgkins store in 2014.

Larry D. Dunn brought suit May 6 in Cook County Circuit Court against Menard Inc. d/b/a Menards of Hodgkins, claiming liability for a January 2014 injury.

According to the filing, Dunn was picking up building insulation from an outside storage area at the defendant’s facility located at 6100 East Ave., Hodgkins, on Jan. 3, 2014. The suit states that a stack of insulation fell on the plaintiff as he was retrieving insulation from a separate pile.

Maintaining that Menards knew or should have known about the hazard, the claim alleges the retailer operated, managed, inspected or controlled the premises carelessly and negligently; and failed to stack the insulation properly, take safety precautions, or post warning to the plaintiff and general public.

Asserting his damages were a consequence of the defendant’s acts of omission, the plaintiff claims physical and mental pain, suffering and medical bills. He seeks compensation of more than $50,000, plus attorney’s fees and costs. Dunn is represented in the case by Ralph J. Licari, of Ralph J. Licari & Associates of Chicago.
