A Chicago woman filed suit against Aldi and the property manager its Morton Grove store for alleged negligence in an incident in a shopping center parking lot.
Barbara Mataczynski, of Chicago, brought suit May 8 in Cook County Circuit Court against Aldi Inc. and Daniel G. Kamin Melrose Park Enterprises LLC, a Delaware corporation, claiming liability in a June 2013 incident.
The suit said defendant Kamin Melrose Park owned and maintained a parking lot at 1345 W. North Ave., Melrose Park. According to the complaint, Mataczynski sustained injuries when she tripped on a parking bumper in a pedestrian traffic area on June 3, 2013.
The suit alleges negligence in placing the bumpers in such a way as to create an obstacle; failing to paint them a bright color to contrast their height against the pavement and prevent a tripping hazard; neglecting to inspect the premises and maintain the parking lot in a reasonably safe condition; and failing to warn the public of hazard.
The suit cites internal and external physical damage; pain, suffering and mental anguish; loss of a normal life; and medical bills in seeking compensation of more than $50,000, plus attorneys’ fees and costs. Mataczynski is represented by Michael Fiorentino, of Fiorentino Law Offices in Chicago.
