The estate of a former resident is filing a lawsuit against a Westchester nursing home for allegedly administrating a lethal dose of an antidepressant.

Andrea Bradley, as administrator of the estate of Luveraneize Caldwell, filed a lawsuit June 16 in Cook County Circuit Court against SSC Westchester Operating Co., doing business as Westchester Health and Rehabilitation Center, alleging violations of the Nursing Home Care Act.

According to the complaint, Caldwell was a resident of the defendant's center from June 18, 2013, until discharge on June 28, 2013, when she was transported to Elmhurst Memorial Hospital due to unresponsiveness, low respiration and a low pulse rate. The suit says 

she was diagnosed there with an altered mental state and determined the defendant allegedly failed to follow Caldwell's psychotropic management policy," by treating her with 15 milligram daily doses of Remeron.

According to the lawsuit, this led to an overdose which contributed to Caldwell's death.

Bradley seeks damages of more than $100,000, plus costs. She is represented by attorney James P. Lynch, of the Keating Law Offices in Chicago.
