Estate alleges man's care was negligent prior to his death

A man's estate is suing a nursing home, alleging neglectful care prior to his death.

Judith Marolewski, as executor of the estate of Leon A. Krynicki, filed a lawsuit June 24 in Cook County Circuit Court against Villa Healthcare Holland Home, doing business as VHC Holland Home and Holland Home; VHC Holland Home Assisted Living; and VHC Holland Home Memory Support, alleging negligence.

According to the complaint, from April 2013 to March 9, 2015, Krynicki received care at Holland Home, 16300 Louis Ave., South Holland. On March 6, 2015, Krynicki had a stomach flu, the suit says, and the defendant recommended he be transferred to the facility's fifth floor, where, for a higher fee, he'd receive more personalized care.

While there, the lawsuit continues, Krynicki was found by Marolewski to be sleeping in his regular clothes, in a wheelchair without his shoes or socks and his glasses on the floor; his dentures on the bed quilt; his reading glasses broken; his bath schedule unclear; dirty clothes overflowing in his hamper; missing clothes; several bruises; his detergent used by other residents; not having towels, gloves or cleaning wipes available; not having his water bottle refilled; his emergency cord unanswered for a long period; not having food brought to him and having the food mixed up with another resident; or having the food without silverware, condiments, plus cold food without drinks or creamer; and having an unknown man sitting on his toilet.

As a result, the lawsuit states, the plaintiff suffered injury, medical expenses, and pain and suffering to include "hunger, uncleanliness, skin irritation, bruises, a bedsore, crack in his skin; and arm and shoulder pain," all of which contributed to a deterioration of his condition just prior to his death.

Marolewski seeks damages of more than $100,000, plus costs. She is is represented by attorney Christine E. Smith, of Chicago.
